Residence permit in Latvia
Residence permit for a property buyer
In Latvia, the construction industry is well developed and continues to develop, many modern housing complexes are being built for every kind of taste. Also, it may be of interest that various commercial centers and business premises are widely available both in Riga and in other cities of Latvia.
The purchase of residential or non-residential property in Latvia, after transferring the property data to the land register, is the basis for obtaining a TRP in Latvia for a period of up to 5 years.
In order for you to qualify for a TRP in Latvia, the purchased property must meet the following criteria:
- The value of the purchased property must be at least € 250,000, and the cadastral value of at least € 80,000. If the cadastral value is not enough, it will need a certified real estate valuation that will confirm its market value of at least € 250,000.
- The real estate seller is an individual, a citizen or non-citizen of the Republic of Latvia or EU countries and legally resides in Latvia, and a legal person established in Latvia, EU countries, European Economic Area or the Swiss Confederation, is a tax resident of Latvia.
- Payment for the property is fully made by bank transfer.
- There are no tax debts for the property.
- The property is not used for agricultural purposes.
- The buyer paid the amount of 5% of the value of the property to the budget.
TRP under subordinated deposit
A TRP has the right to request a foreigner who has an agreement of subordinated loan to a credit institution of Latvia (bank).
The obligations for which the bank issued a loan must meet the following criteria:
- The amount of the loan in favor of the bank is at least € 280,000.
- The period of the loan is at least five years.
- Evidence of the legality of the origin of funds.
- A fee of € 25,000 euros has been paid to the state budget of Latvia.
TRP for the self-employed
A TRP can be obtained for a period of up to 1 year by an individual conducting economic activities as a self-employed person in Latvia.
For this you need to:
- Register in the tax office as self-employed.
- Prepare a business plan for the year and confirm it with a sworn auditor.
- Obtain a permit (license or certificate) if the activity is licensed.
- Pay at least € 9,960 per year, or € 800 per month to the state and local government budget when calculated for an incomplete fiscal year.
In the case of self-employed, the procedure for obtaining a residence permit must be carried out annually.
Residence permit for an individual merchant
A TRP can be obtained for a period of 5 years by an individual merchant in Latvia registered in the Latvian Commercial Register. To obtain a TRP on a specified basis, you must provide:
- Register IM in the commercial register.
- Prepare a business plan for the planned period of the TRP and confirm it with a sworn auditor.
- Obtain a permit (license or certificate) if the activity is licensed.
- To pay to the state and local government budget not less than € 14,230 per year, or € 1,150 per month when calculated for an incomplete fiscal year.
TRP for studies in higher educational institutions
A TRP can be obtained for study at the accredited educational institutions in Latvia for a full course for a scholar or a student. To obtain a residence permit on a specified basis the applicant must submit:
- Contract with the educational institution.
- The document showing what education level is necessary to start learning.
A TRP can be obtained for a period of one year, if your stay in Latvia is related to the exchange of scholars or students, a practice or internship in a Latvian educational institution or in a Latvian company.
TRP for family reunification
You can get a TRP in Latvia in cases related to family reunification, namely:
- You are the spouse of a Latvian citizen, non-citizen of Latvia or a foreign citizen who has a permanent residence permit.
- You are a minor child of a Latvian citizen, a non-citizen of Latvia, or a foreign citizen who has a permanent residence permit.
- You are a relative up to the third civil degree in a straight line or to a third civil degree on the sideline, or a relative (for example, between a spouse and blood relatives of the other spouse) to a third-degree citizen of Latvia, a non-citizen of Latvia, or a foreign citizen who has a permanent residence permit.
- You are a child of a Latvian citizen or parents of a Latvian citizen or non-citizen.
Residence permit for other cases
You can get a residence permit in Latvia in other cases, namely:
- Within the framework of cooperation with registered scientific institutions;
- During the time of treatment in the hospital;
- During the period of custody and guardianship established by the competent authorities;
- Because of the process of divorce, as well as in the connection with the criminal process;
- For religious ceremonies or entering a registered monastery.
Timeframe of implementation
The deadline for obtaining a TRP in Latvia directly depends on the basis on which an individual intends to get the right to stay in Latvia. These periods in normal cases (not requiring in-depth investigation by the competent structures) vary from 30 to 75 days (1-3 months). The classic validity period of a TRP is up to 5 years. Once a year the TRP must be registered (renewed).
Annual registration of a TRP in Latvia
It is important to remember that if the TRP in Latvia has been issued for more than one year, it must be registered annually. A person who has received a residence permit in Latvia annually registers it 30-90 days before the end of each annual period. If the TRP is valid for several years, the residence permit must be registered every year.
The decision on the registration of a residence permit in ordinary cases (not complicated and not accelerated) is taken within 30 days.
Costs
Except the predetermined fee of the Company for issuing a TRP (look for tariffs in the About Us, Price List section), you will incur overhead costs when you apply for a TRP. The overhead cost for obtaining a TRP is also directly dependent on the basis of the TRP. In some cases it is required to request and translate documents and go through other formalities. The Department of Citizenship and Immigration charges a state duty for the invitations, checking the documents submitted for obtaining a TRP in Latvia and issuing the TRP. A duty is charged on each applicant and member of their family, the exact amount of the state duty per person depends on the urgency of the consideration and the basis for the paperwork. In normal cases, the sum of all state duties per person ranges from € 100 to € 200 for each family member.
